Updated Rent Assistance Notice


Attention all Members,

The state has released an updated Rent Assistance Notice that must be included with any notice for nonpayment of rent. Under Oregon law, “rent” includes all amounts owed to the landlord except for charges related to damage to the premises. This means late fees, NSF fees, noncompliance fees, and utility charges are all considered “rent” for this purpose.

The Forms Committee and our partners at Central Oregon IT are updating all affected online forms to comply with the new requirements, including:

  • VT1a – 13-Day Notice to Pay or Vacate for Nonpayment of Rent
  • VT2a – 10-Day Notice to Pay or Vacate for Nonpayment of Rent
  • VT3 – 72-Hour Notice to Pay or Vacate for Nonpayment of Rent – Week-to-Week Tenancy
  • VT5 – Notice of Termination with Cause

Local associations can begin ordering updated printed forms tomorrow. We expect the updated website forms to be available tomorrow as well. In the meantime, you should print and attach the revised Rent Assistance Notice to any nonpayment notice you serve. You may continue selling the existing versions of the above-listed forms, provided you give members the correct accompanying notice.

Regarding SB 690B compliance: the Oregon Judicial Department has added a link for parents of infants to “click for more information,” but currently that link only leads to the OJD Online Forms page—which, unfortunately, contains no actual information. Our legal advisors confirm that, despite the lack of content, the revised notice is legally acceptable and may be used as-is until the state provides updated information.
