Important Update – Changes to ORHA Form #T5 (Notice of Termination for Qualifying Landlord Reason)


Attention all Members,

We want to make you aware of an important change affecting Notice of Termination – Qualifying Landlord Reason (Form #T5).

The Oregon REALTORS®️ successfully advanced legislation modifying the notice period for property sales when the buyer intends to occupy the unit as their primary residence.

What Changed

  • Previously: A 90-day notice was required, and payment of one month’s rent applied only if the owner held an interest in more than four residential rental units in Oregon.
  • Now (effective September 29, 2025, under Senate Bill 586A):
    • A 60-day notice is permitted under these circumstances.
    • Payment of one month’s rent is required in all cases, regardless of the number of units owned.
    • If the landlord already falls under the relocation fee requirement (ownership interest in five or more residential rental units in Oregon), an additional month’s rent is owed.
    • Note: “Units” means individual rental units, not buildings.

Reminder on State Law

Oregon law requires landlords to pay one month’s rent when terminating a tenancy of more than one year for a Qualifying Landlord Reason.

When Form #T5 Still Applies

The current version of Form #T5 remains valid for other Qualifying Landlord Reason terminations, including when:

  • The landlord will demolish the unit or convert it to non-residential use.
  • The landlord or an immediate family member will occupy the unit as their primary residence.
  • The landlord will renovate the unit, making it unsafe or unfit for occupancy during the work.
  • The landlord is selling to a buyer who, in good faith, intends to occupy the unit as their primary residence.

City-Specific Restrictions

Please note: Properties located within the Eugene Rental Housing Code jurisdiction or under the Portland Housing Bureau are not eligible for this change due to local restrictions. Special city-specific forms must be used for properties within the urban growth boundaries of these jurisdictions.
