President's Message

Tia Politi, ORHA President

Fun in Bend
September in Bend is the best meeting of the year! The ORHA Executive Committee has a great evening planned for those of you who will be attending our annual Leadership Dinner on Friday, September 19th 6 p.m. in the Rambler Room at McMenamins. The dinner is hosted, but adult beverages are not covered for insurance reasons so bring your wallet if you want to purchase libations.

We’ll be having a luau feast (feel free to wear Hawaiian attire) with committee chairs speaking briefly on their current projects and future visions. We’ll also be hearing from the leaders of our local associations to report on their progress, successes and roadblocks. As our locals go, so we all go. Mentoring is proving very helpful, but only if we know where...

Donate Today!

Please read the attached Election Analysis from ORHA's Lobbyist Shawn Miller, and please consider making a donation today!

Legislative Supermajorities at Stake this Election:

The current makeup of the legislature is 17 (D)-12 (R), 1 (I) in the Senate and 35 (D)-25 (R) in the House. Both chambers are just under the supermajority threshold of 36 in the House and 18 in the Senate. Why is this significant?

Supermajorities in the legislature creates leverage on both fiscal and policy fronts. For the Democrats, a supermajority allows them to raise taxes without votes from Republicans which could be key next session when the legislature looks for additional revenue for a transportation plan and increased education funding. Supermajorities also minimize the opposition from moderates within...

With your donation, the ORH KEY PAC can continue to strengthen relationships with Oregon Legislators who have our best interests in mind. However, time is running short for donations, and the committee plans on sending the final round of campaign contributions by late August.

Your donation, whether large or small, can make a significant impact. Here’s how you can contribute:

P.S. You may qualify for the Oregon Political Tax Credit if you're an Oregon taxpayer making under $75,000, or $150,000 per year as part of a joint-filing couple. If you qualify, you can give up to $50 per year to Oregon Rental Housing KEY PAC and receive the full amount as a credit subtracted from your Oregon state taxes when you file (If you're part of a joint-filing couple, you can give up to $100 a year). Oregon law allows a tax credit for political contributions. You may not claim this credit if your federal AGI exceeds $150,000 on a jointly filed return, or $75,000 on all other returns. Please consult your tax advisor for more information. Don't qualify? We can still use your help funding our important work to elect Representatives and Senators that support Oregon Landlords in 2024! Please donate any amount you can today.

Forms Committee Update

Tia Politi, Committee Chair

Thank you to SOROA member Cliff Conner - Coash for bringing a service box issue to our attention in form O4 – Notice to Enter. Because “actual notice” is allowed for entry, our change in service boxes needed another change on this specific form. The change has been made in the store and for printed forms moving forward. If you have older forms, they can still be used, just be clear that you’re posting only or using some other method of service by Actual Notice as allowed under ORS 90.155. Basically, actual notice can be posting on the door or leaving a message on an answering machine and remember if the right is listed in your rental agreement and the tenant has agreed, you may provide notice to enter by email or text.

It can get confusing because other legal notices such as termination notices or rent increases may not be provided by Actual Notice, but only by written notice as allowed by law. Read or re-read my article Serve it Right! for an in-depth rundown on the options for serving legal notice and remember, do it right or a tenant attorney would be happy to educate you for an exorbitant fee.

The committee is also working on a revision to form #T2 – Notice for Harm or Substantial Damage and we’ll let you know when that is ready – likely later this month.

We are still accepting suggestions for new forms and changes to our existing forms, so if you see any issues or have any suggestions, please send an email to forms@oregonrentalhousing.com.

But, of course, now our biggest focus is the Law Book. We expect that it will be sale-ready by the end of the year! More info to come.

Mind Your Business: Tia's Tips for Better Rental Management – Risk Management for Risky Times

Tia Politi

Running a business is full of risks – kind of like the rest of life. I’m a risk-averse person which has served me well as a landlord. When I was a property manager, my nickname was The Voice of Doom because I was always pointing out possible problems to my owners that could get them sued. There are three major categories of risk for landlords: the property, the tenants, and you.

PROPERTY RISKS
Property risks run the gamut from the obvious to the barely discernible. Obvious areas of risk would include electrical, heating or plumbing systems in poor condition; windows or doors that don’t open, close or lock properly; rickety banisters; rotting deck boards; etc. In addition to providing a legally habitable property, Oregon Landlord Tenant law requires that...

Oregon Annual Rent Increase Percentage

Senate Bill 611 was signed into law on July 06, 2023. This bill will cap rent increases at 10.0% or 7.0% plus CPI (whichever is lower) – The exemption for new constructions remains at 15 years.

The maximum allowable rent increase percentage for the 2024 calendar year is 10.0% or 7.0% plus CPI (whichever is lower) – The allowable annual rent increase in 2024 is 10.0%. Only one rent increase may be issued in any 12-month period.

The allowable rent increase percentage for the previous year, 2023, was 14.6% if the increase was issued before July 6th, or 10.0% if issued after July 6th.

For more information on the methodology, calculation, and Consumer Price Index data, see: Maximum Annual Rent Increase, 2024 (Excel File Download).

ORHA appreciates your participation during this legislative season – Please contact the member helpline for your local association with any questions that you may have. If you do not know the contact information for your local association, you can view the information by clicking HERE.

Education Committee Update

Jason Miller, Committee Chair

The committee continues to work on updating classes and providing Webinars, as well as in-person classes.

Mentor Locals: If your Association has less than one hundred members, you are entitled to support from the ORHA Mentor Program. This includes providing classes to your members at reduced costs, helping set up or reviewing your bylaws, and many other services. Recently, we have worked with ROADC, TVRA, CCROA, ROANEO, MCROA, and UCRHA.

Did you know you could take classes offered by other locals? If you are member of another local, you can ask if a member discount can be provided. Check the ORHA website for class offerings.
